Proper Reference and Use of Marks

Following guidelines must be used when referencing service marks, trademarks, and trade name of the CORPORATION:

  1. Always include the proper notation after the CORPORATION's marks, name, or logo as exampled in the "Service Marks, Trademarks, and Trade name" section above. Use ® for registered service marks, trademarks, and trade name; TM for trademarks; SM for service marks; and a reference of trade name ownership by FlexVantage Corporation.
  2. All service marks and trademarks must be used as adjectives. No service mark or trademark may be made possessive, used standalone as a noun, or used as a verb.
  3. It is only necessary to annotate the first instance of a service mark, trademark, or trade name in the text of a given document or piece. After the first instance, you may drop the ®, TM, SM, or trade name statement after the word. When using logos or in illustrations, always include the ®, TM, or SM in every instance.
  4. The CORPORATION's ownership of its service marks, trademarks, trade name, and logo must be referenced in footnotes at the bottom of printed materials as shown: "Copyright © FlexVantage Corporation. All rights reserved. The FlexVantage Corporation name and logo are service marks or trademarks of FlexVantage Corporation."
  5. Proper spelling and syntax must be used when referencing the CORPORATION's service marks, trademarks, and trade names.
  6. When using the CORPORATION's logo, never modify the design, add or delete any elements or words, and change any colors or proportions.
  7. The CORPORATION's logo must be used as a stand-alone icon and without any form of association to any other logos and/or trademarks.
  8. Third-party names, logos, and marks can be used in conjunction with the CORPORATION's brands and logos ONLY IF it is to connote that the CORPORATION's technology is included as part of the offering. The CORPORATION's brands and logos may not be used as part of any product name for any third-party product in any shape or form.

The CORPORATION respects intellectual property of others. If you believe that you hold a claim of copyright, service mark, trademark, or patent infringement against the CORPORATION, submit notice of your claim to the CORPORATION in writing at the following address:

Pursuant to Title 17, United States Code, Section 512(c)(3), the notification of your claim of alleged copyright, service mark, trademark, or patent infringement against the CORPORATION shall be in writing. You may use fax, E-mail, or postal mail to submit the notification of your claim to the CORPORATION. The notification shall include all of the following information for completeness and in order to be deemed actionable:

  1. A statement that you are the owner of the exclusive right which you claim has been infringed.
  2. If you are not the owner of such exclusive right, a legal statement that you are authorized to act on behalf of the owner of the exclusive right which you claim has been infringed.
  3. The complete description and identification of the alleged infringement. (If your claim includes multiple infringements, you can submit one notification with a list of alleged infringements. You shall provide complete information on every claim as outlined herein.)
  4. A statement of a good-faith belief that use of the material in the manner that is complained of was not authorized by the owner of the exclusive right, a representing agent, or the law.
  5. Sufficient amount of information and appropriate level of authorization to the CORPORATION in order for the CORPORATION to locate and review the material you claim has been infringed.
  6. A statement requesting the CORPORATION to take a specific action with respect to the alleged infringement.
  7. A statement, under penalty of perjury, that the information included in the notification of your claim is accurate.
  8. Your signature. (The signature may be electronic if the notification is mailed electronically.)
  9. Sufficient contact information about you and the owner of the exclusive right that you claim has been infringed. Such contact information shall include mailing address, telephone number, fax number, and, if available, an electronic mail address.
